1. Agreement to Terms
By booking and using ORIIA Studios ("the Studio"), you ("Client," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use our facilities.
2. Contact Information and Communications
By providing your email address and phone number, you consent to:
- Receiving booking confirmations, reminders, and studio-related communications
- Being contacted regarding your reservation, facility updates, or administrative matters
- Receiving occasional promotional communications (you may opt out at any time)
- Having your contact information stored securely for booking management purposes
3. Cancellation and Refund Policy
24-Hour Cancellation Rule:
- Full Refund: Cancellations made at least 24 hours before your booking start time will receive a full refund
- No Refund: Cancellations made within 24 hours of your booking start time are non-refundable
- Refunds will be processed to the original payment method within 5-7 business days
- No-shows are considered cancellations within 24 hours and are non-refundable
- ORIIA Studios reserves the right to cancel bookings due to facility emergencies, with full refunds provided
4. Liability Waiver and Assumption of Risk
IMPORTANT - PLEASE READ CAREFULLY:
By using ORIIA Studios, you acknowledge and agree that:
- Assumption of Risk: You voluntarily assume all risks of injury, damage, or loss that may occur while on the premises, whether caused by the condition of the facilities, equipment, or your own actions
- Release of Claims: You waive, release, and discharge ORIIA Studios, its owners, employees, and agents from any and all liability, claims, demands, or causes of action for personal injury, property damage, or wrongful death arising from your use of the facility
- Personal Responsibility: You are solely responsible for your own safety and the safety of any guests you bring to the studio
- No Warranties: The studio facilities and equipment are provided "as is" without any warranties of safety or fitness for any particular purpose
- Indemnification: You agree to indemnify and hold harmless ORIIA Studios from any claims, damages, or expenses arising from your use of the facility or any actions by you or your guests
This waiver is binding on your heirs, successors, and assigns.
5. Property Damage and Responsibility
You are fully responsible for any damage caused to the studio premises, equipment, or furnishings during your booking period:
- Damage Assessment: ORIIA Studios will assess any damage after your session and notify you within 48 hours
- Repair Costs: You agree to pay for all costs associated with repairing or replacing damaged property
- Payment Terms: Damage charges will be invoiced separately and must be paid within 14 days of notification
- Examples Include: Stains on floors or backdrops, broken equipment, damaged walls, or any alterations to the space
- Normal Wear Excluded: You are not responsible for normal wear and tear from intended use
- Security Deposit: ORIIA Studios reserves the right to require a security deposit for certain bookings
6. Studio Usage Rules
- Punctuality: Arrive on time for your booking. Late arrivals do not extend your session end time
- Capacity Limits: Respect maximum occupancy limits for safety and comfort
- Prohibited Items: No smoking, illegal substances, or dangerous materials on premises
- Cleanliness: Leave the studio in the same condition you found it
- Equipment: Use all equipment carefully and as intended. Report any malfunctions immediately
- Noise Levels: Maintain reasonable noise levels to respect neighboring businesses
- Food and Drink: Food and non-alcoholic beverages are permitted but must be consumed carefully
7. Payment Terms
- Payment Due: Full payment is required at the time of booking
- Accepted Methods: We accept major credit cards and digital payment methods
- Pricing: All prices are subject to change without notice for future bookings
- Additional Charges: Any damage charges or additional services will be billed separately
- Disputes: Payment disputes must be reported within 30 days of your session
8. Privacy and Content
- Privacy: Your booking information is kept confidential and used only for business purposes
- Photography: ORIIA Studios may photograph the space for marketing purposes but will not photograph clients without permission
- Content Ownership: You retain ownership of all content created during your session
- Studio Promotion: You may reference ORIIA Studios in your work credits with our permission
9. Force Majeure
ORIIA Studios is not liable for any failure to perform due to causes beyond our reasonable control, including but not limited to natural disasters, government actions, power outages, or other emergencies. In such cases, we will work with you to reschedule or provide appropriate compensation.
10. Modification of Terms
ORIIA Studios reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on our website and apply to all future bookings. Continued use of our services after changes constitutes acceptance of the new terms.
11. Governing Law
These Terms and Conditions are governed by the laws of the State of Texas. Any disputes arising from these terms or your use of ORIIA Studios will be resolved in the courts of Texas.
12. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
